1. INFORMATION ABOUT US

This website, located at www.contentaim.com or any of our affiliated sites (collectively, the "Site"), is provided by Content Aim, (“ContentAim,” "we," "our," or "us") to the person accessing this Site ("you," "your").

 

 

2. HOW THESE TERMS APPLY TO THE SALE OF “WEBSITE” SERVICES & PRODUCTS

2.1

These terms and conditions of sale, (together with any relevant documents referred to in them, including the Website “Terms of Use”) set out the terms on which we supply website services and products, via our site to you:

Your use of the website is governed by this Agreement, as applicable, and the ContentAim “Terms of Use” and “Privacy Policy”.

When you purchase one or more of our website services and products, you will be deemed to have fully accepted these terms and conditions. Any purchase/use of our website services and products implies that you have accepted our terms and conditions.

All of these agreements together constitute the entire agreement, as modified from time to time, between you and ContentAim with respect to your use of the website and the services provided on and through the website. Your use of the website and the services provided is conditioned on your acceptance of all terms of these agreements. To the extent that there may be any conflict or inconsistency between our terms and conditions on our website and our Privacy Policy, in respect of your use of and/or order for content services and products, the following order of precedence will apply:

3. ABOUT YOU

3.1

By placing an order for content and/or branding services and products through our website, you warrant that:

(a) You are legally capable of entering into binding contracts;

(b) You are at least 18 years old;

(c) If you hire ContentAim on behalf of a marketing agency, who require us to work for it, on a project for one of its clients, a contract will only exist between ContentAim and the agency, (not between ContentAim and the marketing agency’s client).
 

3.2

By placing an order for website services and products you agree that we may store, process and use personal data collected from you for the purposes of processing and fulfilling your order.

 

 

4. ORDER

4.1

To place an order for website services and products; you will be required to provide us with certain information including certain personal details so that we can process your order.

 

 

4.2

You agree to provide us with truthful, complete and accurate information in the order.

 

5. PAYMENT & DELIVERY OF YOUR WEBSITE SERVICES & PRODUCTS

5.1

All orders must be made via our esty shop and your website will only be transferred to you upon receipt of the cleared funds to our account:​

Transfer of your websites:
 

(a) All payments to ContentAim should be paid by electronic bank transfer (not cheque), with the Client paying all sender and recipient bank charges. Our bank details are can be found on our invoice. Please note that we cannot start work on your content until you have made the agreed payment via electronic bank transfer, and the payment has cleared.
 

(b) Upon receipt of the cleared funds to our account, ContentAim will transfer your website, via a downloadable link to your e-mail address. You can also download your website guidelines from there. It will be in the form of a PDF file.

5.2

What Is Not Included
 

(a) A domain - you must purchase this separately from your preferred domain provider and then connect this to your Wix account / template.
(b) Wix web hosting - you must subscribe to either a monthly or annual fee package and make payments directly to Wix. You can view their pricing options to find the package to suit your requirements. Please note that all our website templates must be hosted on Wix's servers.

5.3

Custom Content 
 

Revisions

​

Should revisions for custom content be absolutely necessary, we will undertake this as quickly as possible, at no additional charge. Revision only includes editing, not complete rewrites. Revisions can only be made if you request this within 7 days of your receipt of the original content, (and/or brand identity guidelines) which ContentAim delivered.
Revisions cannot be made in relation to a fundamental change in your project requirements, that are beyond ContentAim’s control: i.e. we will not be able to make changes if we have delivered to a brief, which you later decide to change.

(a) Some examples of acceptable revisions are:

• Writing in the ‘third person’ instead of the ‘first person’;

• Using numbered points instead of bullet points; and

• Using alternative quotes.

 

(b) Free revisions will only cover two proofs, after which point, charges will be attached to any further amendments, at the rate which is stated in our contract. However, prior to any changes, ContentAim will advise you of any potential charges.

(c) Complete rewrites due to your decision to change the brief will require you to make a new order, and a new quote will then be provided.

 

 

5.4

The contract for the purchase of any content and/or branding services and products will be between you and us, and formed by these “Terms and Conditions of Sale”. They shall be governed by and construed solely in accordance with English law and the “Client” and “ContentAim” submit to the exclusive jurisdiction of the English Courts to the exclusion of all other courts and systems of law. We reserve the right, in our sole discretion to reject any order we receive.

 

5.5

All of the website services and products and associated services which are featured on our website are strictly subject to availability. We reserve the right to change or remove website services and products and/or associated services, or other content on the site at any time, and without notice or liability to you. For example, we may need to remove the service from the site and make it unavailable for purchase. You agree that you will have no claim against us, in respect of any decision to remove website services and products from our website, or any decision to suspend or terminate your access to our website services and products.
 

5.6

You agree to provide us with truthful, complete and accurate details. You also agree to provide us with your details only. You are responsible for all orders placed/activity undertaken using your account details.
 

5.7

Prices for website services and products are liable to change at any time, but this will not affect orders in respect of which we have already taken payment and delivered to you.
 

5.8

By making payment via our etsy shop, of the agreed price that is due, you confirm that you are authorised to purchase website services and products, and any related services, and that you are the holder of the relevant payment account or are expressly authorised to use the payment account.

6. COPYRIGHT 

6.1

(a) You retain the copyright to any data, files or graphics which you provide, and you grant ContentAim the rights to publish and utilize any material which you provide. You agree to obtain the relevant permission and rights to use any files or information which is copyrighted by a third-party. You also accept full responsibility for any claims which may result from your failure to obtain proper copyright permissions.

 

(b) You will not own the exclusive license to the website template which you purchased. The template is premade, and it WILL BE RESOLD. You agree that ContentAim may continue to use any proprietary products and methods which it used in the course of the Project. ContentAim shall be free to apply the concepts, techniques, know-how used and developed on the project. You also agree that ContentAim may showcase your website on it's website, and in it's online and offline marketing materials.

 

6.2

Website services and products are written in the English language only. Your website and any associated guidelines will be written in British English format.

 

 

7. INDEMNIFICATION

7.1

Our service will be provided with reasonable care and skill and we will use our best endeavours to ensure that the website template and any associated guidelines are free of errors and omissions, however, we cannot guarantee this. Therefore, we recommend that you review the website template and any associated guidelines thoroughly before publishing it, as you will solely be responsible for what you publish.

ContentAim does not warrant the accuracy of any data provided by way of ‘website content’, ‘guidelines’ or conclusions; nor does it accept liability for any error contained in or omission from any ‘website content’ and ‘guidelines’, or any loss, whether direct or consequential.

 

7.2

(a) Your use of this website is at your own risk. You agree to indemnify, defend, and hold harmless ContentAim, its officers, employees, agents, licensors, and suppliers from and against all losses, expenses, damages, and costs, (including reasonable legal fees), resulting from any violation of these “Terms and Conditions of Sale”, (including negligent and/or wrongful conduct) by you.
 

(b) You also agree that use of this site to access or purchase website services and products is at your sole risk. ContentAim will not be liable for any losses, injuries, or damages from the sale of website services and products and associated services. Neither ContentAim, nor any of its affiliates, officers, agents, or any other party involved in creating, producing and/or delivering website services and products and associated services, are liable for any indirect, direct, incidental, punitive, special, consequential or other damages arising out of and/or connected with the sale of website services and products and associated services. This includes, without limitation any liability for: loss of income or revenue; loss of business; loss contracts and/or wasted management or office time; loss of anticipated savings; loss of, damage to or corruption of data; loss of goodwill; and for any other loss or damage of any kind, however arising and however caused, (even if foreseeable).

c) Neither ContentAim, nor any of its affiliates, officers, agents, or any other party involved in creating, producing and/or delivering website services and products and associated services, are liable for failure to perform obligations due to force majeure, e.g. any event or circumstance beyond its reasonable control, including, but not limited to, acts of God, acts of war, fire, insurrection, strikes, lock-outs or other serious labour disputes, riots, earthquakes, floods, explosions or other acts of nature.

 

 

8. MEANS OF COMMUNICATION

8.1

When using this website, you accept that communication with us will be via electronic means. We will contact you by e-mail (at the e-mail address you provided via our etsy shop and/or on our contact form), and we may also provide you with information by telephone and/or, by posting notices on our website. You agree to electronic means of communication and you acknowledge that this complies with any legal requirement that communications be in writing.

 

 

9. NOTICES

9.1

All notices given by you to us must be sent either directly to us via our etsy account or our ‘Contact’ form on our website. Notice will be deemed properly served and received, immediately when it is posted on our website, or 24 hours after an e-mail is sent to you.

 

 

10. SUB-CONTRACTING

10.1

You agree that we may sub-contract our obligations, for example contracting with a third-party company to deliver your website services and products.

 

 

11. REFUNDS & CANCELLATIONS

11.1

Since ContentAim.com is offering a non-tangible, irrevocable product, which is easily copied, we do not issue refunds once we have transferred your template to you. It is your responsibility as the customer to review, enquire and understand ContentAim's refund policy prior to purchasing any websites template and associated services from our etsy shop. As our website templates can easily be copied upon us transferring it, we therefore cannot honour any requests for refunds on any templates and associated services that have been provided.
 
 

12. RESOLUTION OF DISPUTES

12.1

Please note that we have made every effort to ensure that our website services and products are described clearly on our website. If a dispute arises between you and ContentAim our goal is to resolve such dispute quickly and cost effectively.
 

12.2

It is our goal is to ensure that all our clients are totally happy with the work we undertake, and overwhelming this is the case. However, misunderstandings can sometimes happen. So all we ask is that you work with us to resolve any dispute that arises between us out of this Agreement, in accordance with this “Terms and Conditions of Sale”, before resorting to alternative action. We can assure you that we will do our very best to resolve your concerns and reach a satisfactory resolution for you.
 

 

13. OUR RIGHT TO VARY THESE TERMS AND CONDITIONS OF SALE

13.1

We reserve the right to update or modify or “Terms and Conditions of Sale” at any time, and without prior notice to you. Your use of our website following such modification or update constitutes your acceptance to be bound by the “Terms and Conditions of Sale”, as changed or modified. We encourage you to read through and review the “Terms and Conditions of Sale” each time you access our website.
